Terms of Service

By accessing or using the hardware, software, or services ("Services") provided by Air Signal Labs LLC ("Air Signal Labs," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these Terms, you do not have permission to access the Services.
1. Passive Monitoring and Non-Transmission
Towerless hardware is designed as a passive radio monitoring device. It is not designed to intentionally transmit on monitored radio channels or broadcast radio frequency energy as part of its monitoring function. Any modification or use that causes intentional radio frequency transmission on licensed, regulated, or operational frequencies is a material breach of these Terms and may result in immediate termination of service, forfeiture of warranty, and referral to relevant telecommunications authorities.
Towerless hardware is designed for passive monitoring of lawful, public, unencrypted, or otherwise authorized operational signals. It does not replace licensed operators, air traffic control, emergency services, dispatch authorities, or official regulatory systems.
2. Limitation of Liability
Air Signal Labs provides passive intelligence and transcription services. Our data and Services are strictly for supplementary operational review and post-incident documentation. THEY MUST NOT BE USED FOR AIR TRAFFIC CONTROL, SEPARATION SERVICES, FLIGHT CRITICAL OPERATIONS, OR LIFE SAFETY PURPOSES.
In no event shall Air Signal Labs, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Services, even if Air Signal Labs has been advised of the possibility of such damages. Air Signal Labs' total liability to you for all claims arising out of or related to the Services will not exceed the amounts paid by you to Air Signal Labs in the twelve months preceding the claim.
3. Reservations and Hardware Orders
3.1 Pre-Production Status
Towerless hardware is currently in pre-production development. Product renderings, feature descriptions, software interfaces, and specifications shown on the Air Signal Labs website or in marketing materials represent the intended production design and may change before shipment. Placing a reservation does not constitute a guarantee of a specific hardware configuration, final specification, or shipment date.
3.2 Configuration and Batch Assignment
Reservation holders will be contacted at the email address associated with their reservation before their assigned production batch is locked. This contact will include available configuration options, estimated shipment timing, final hardware pricing, remaining balance due, and any material production changes. Failure to respond within the notified window may result in the reservation being deferred to a subsequent batch.
3.3 Reservation Refund Policy
Your $99.00 USD reservation deposit secures your place in the Towerless production queue and is applied toward your final hardware purchase.
Your deposit remains fully refundable until your assigned production batch enters manufacturing.
For Founder Reservations in the first Towerless production batch, the refund window remains open until the first Towerless production batch enters manufacturing.
Before a production batch enters manufacturing, Air Signal Labs will make reasonable efforts to notify reservation holders using the email address associated with their reservation. This notice may include updated configuration details, estimated shipment timing, final pricing, remaining balance, and any material production changes.
Once your assigned production batch enters manufacturing, your $99.00 deposit becomes non-refundable and is applied toward your final hardware purchase. At that point, your unit is allocated for production.
Air Signal Labs will refund your reservation deposit in full if:
- Air Signal Labs cancels the product or determines it cannot fulfill the First Production Run;
- Air Signal Labs cannot offer your reserved configuration and you do not accept an alternative;
- Air Signal Labs cannot proceed with shipment for reasons not within your control;
- Air Signal Labs makes a material change to the core hardware capability (not software features, dashboard changes, or timeline adjustments) and you do not accept the revised specification within the notification window.
Your deposit is not refundable based on:
- Changes to software features, dashboard functionality, or SaaS pricing that do not alter core hardware capability;
- Customer-initiated cancellation after the assigned batch has entered manufacturing.
First shipments are currently estimated for Q1 2027. Production and shipment estimates may change. A change in estimated timing does not automatically cancel a confirmed production allocation. If Air Signal Labs cannot ship within a stated shipment window, Air Signal Labs will provide an updated timing notice and any refund, cancellation, or delay-consent rights required by applicable law.
3.4 Hardware Specifications
Final hardware enclosure, labeling, accessories, dimensions, interface, and included components may change from pre-production renderings before shipment. Air Signal Labs will notify reservation holders of any material changes to core hardware capability before batch lock.
4. Intellectual Property
The Services and their original content, features, hardware designs, firmware, and software models are and will remain the exclusive property of Air Signal Labs and its licensors. Air Signal Labs' trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Air Signal Labs.
5. Hardware, Radio Frequency, and Regulatory Compliance
5.1 RF Monitoring Function
Towerless hardware is designed to receive and process radio frequency signals. It is not designed to intentionally transmit on monitored radio channels or broadcast radio frequency energy as part of its monitoring function.
Customers are responsible for ensuring their use of Towerless hardware complies with all applicable local, national, and international laws and regulations governing radio frequency reception and signal monitoring, including any applicable telecommunications licensing requirements.
5.2 Equipment Authorization
Final production hardware may be subject to applicable equipment authorization, labeling, importation, or regulatory requirements before shipment. Delivery to end users is conditional on completion of any required authorization process. Air Signal Labs will notify reservation holders of any authorization requirements that affect shipment timing or configuration.
5.3 Operational Limitations
Towerless is not designed, certified, or authorized for air traffic control, aircraft separation, dispatch control, emergency dispatch, emergency response command, life-safety decision-making, navigation, security command, or medical decision-making. Towerless products must not be used for any of these purposes.
6. Software, Data Rights, and Retention
6.1 Software Access and Availability
Access to the AirfieldControl dashboard and associated software features is provided in connection with your Towerless hardware reservation or subscription. Air Signal Labs reserves the right to modify, suspend, or discontinue any software feature with reasonable notice.
Air Signal Labs will publish service availability targets and any applicable service credit terms at the time paid SaaS subscriptions are made available. No uptime guarantee or service credit obligation applies during any free, beta, or pre-launch access period.
6.2 Subscription Plans, Billing, and Refund Policy
Certain software, dashboard, or account features may be offered separately under additional terms. If Air Signal Labs offers a paid software subscription or managed service, the applicable subscription terms, pricing, billing cadence, and service terms will be provided before purchase or activation. No subscription fee will be charged without your express authorization.
Subscription terms and refund policies for any paid AirfieldControl tier will be disclosed at the time of subscription activation. If you believe you have been charged in error, contact billing@airsignallabs.com within fifteen (15) days of the charge.
6.3 Definitions
"Operational Records" means data generated by Customer's deployed Towerless hardware that reflects operations at Customer's facility, including captured audio, voice transcripts, aircraft identifiers, position context, event timestamps, and Customer's channel configuration. Operational Records do not include Service Data.
"Service Data" means technical performance, diagnostic, and telemetry data concerning the operation of the hardware and Services, including capture and detection statistics, transcription confidence metrics, model and correlation performance measurements, radio frequency reception performance characteristics, device health, uptime, connectivity status, and error and fault logs. Service Data expressly excludes audio content, transcript content, aircraft identifiers, and the content of Operational Records.
"Aggregated Data" means statistical datasets derived from Operational Records across multiple Customers in accordance with Section 6.6.
6.4 Customer Ownership of Operational Records
Customer retains exclusive ownership of its Operational Records. Customer grants Air Signal Labs a limited, non-exclusive, royalty-free, worldwide license to host, store, process, cache, transmit, and back up Operational Records as necessary to provide, support, secure, and maintain the Services for Customer, and to exercise the rights expressly granted in Sections 6.5 and 6.6. Air Signal Labs claims no other rights in Operational Records.
Air Signal Labs will not sell Operational Records, and will not disclose Operational Records to any third party except (a) to subprocessors acting on Air Signal Labs' behalf to deliver the Services under written confidentiality obligations, (b) at Customer's written direction, or (c) as required by legal process under Section 6.7.
6.5 Service Data
Air Signal Labs owns Service Data and may use it to operate, secure, support, troubleshoot, and improve the Services and its products, including improving transcription, detection, and correlation performance for all customers.
Air Signal Labs will not publish or disclose Service Data in any form that identifies Customer, Customer's facility, or Customer's deployment configuration without Customer's prior written consent.
6.6 Aggregated Data
Air Signal Labs may create and use Aggregated Data for research, product development, and publication, subject to all of the following conditions:
(a) Minimum threshold. Aggregated Data may be derived only from datasets comprising no fewer than ten (10) distinct customer facilities operated by no fewer than five (5) distinct Customers. For clarity, the threshold counts facilities and Customers, not hardware units.
(b) Exclusions. Aggregated Data will not contain aircraft registration or tail numbers, audio, transcript content, individual event records, geographic information more precise than the U.S. state or FAA region level, or any identifier of a Customer, facility, individual, or aircraft.
(c) Temporal granularity. Aggregated Data will not include timestamps of a granularity finer than one calendar day.
(d) Facility-level statistics.Air Signal Labs will not publish or disclose statistics specific to any single facility or Customer without that Customer's prior written consent.
(e) Opt-out. Customer may opt out of contribution to Aggregated Data at any time by written notice to Air Signal Labs. Opt-out takes effect within thirty (30) days and applies prospectively. Air Signal Labs will not condition access to the Services, or vary pricing, based on participation in Aggregated Data.
(f) Ownership of outputs. Aggregated Data, once created in compliance with this Section, is the property of Air Signal Labs. Underlying Operational Records remain the exclusive property of Customer.
6.7 Legal Process
(a) Civil process. If Air Signal Labs receives a subpoena, discovery request, civil investigative demand, or similar legal demand seeking Operational Records, Air Signal Labs will, unless prohibited by law, provide Customer prompt written notice before producing any records, and will afford Customer a reasonable opportunity to object or seek a protective order. Air Signal Labs will produce only the minimum records required to comply.
(b) Warrants and process where notice is restricted. Where Air Signal Labs is served with a warrant, court order, national security process, or other demand that prohibits or delays notification, Air Signal Labs will comply as legally required, will disclose only what is compelled, and will notify Customer as soon as it is legally permitted to do so.
(c) No voluntary disclosure.Air Signal Labs will not voluntarily provide Operational Records to any government agency, regulator, insurer, or law enforcement body absent valid legal compulsion or Customer's written direction. Customer, as owner of the Operational Records, determines whether and when to disclose its records to any agency or third party.
(d) Public records law.Customer acknowledges that if Customer is a public entity, Customer's Operational Records may be subject to state public records or freedom of information law. Responding to such requests is Customer's responsibility as owner of the records.
6.8 Retention, Legal Hold, and Deletion
(a) Default retention. Unless Customer configures otherwise within the ranges supported by its plan:
- Captured audio is retained for thirty (30) days.
- Transcripts, timestamps, and event metadata are retained for thirty (30) days on Essential, three hundred sixty-five (365) days on Professional, and as configured up to seven (7) years on Command.
(b) Legal hold. Customer may place Operational Records under legal hold, suspending scheduled deletion until Customer releases the hold in writing.
(c) Deletion on request. Customer may request deletion of its Operational Records at any time. Air Signal Labs will delete the records from active systems within thirty (30) days and from backups within ninety (90) days, except records subject to a legal hold or an active legal demand under Section 6.7.
(d) Termination. On termination, Air Signal Labs will make Operational Records available for export for thirty (30) days. Thereafter, records will be deleted from active systems within thirty (30) days and from backups within ninety (90) days.
(e) Effect on Aggregated Data. Deletion of Operational Records does not require withdrawal of Aggregated Data already lawfully created under Section 6.6.
6.9 Model Training
Air Signal Labs does not use Customer audio, transcripts, receiver location, deployment configuration, or site identity to train models unless Customer expressly opts in in writing, or the data qualifies as Aggregated Data under Section 6.6. For clarity, Air Signal Labs may use Service Data as described in Section 6.5 to improve model and system performance.
7. Sensitive Deployments
Government, public safety, defense, airport, critical infrastructure, and other sensitive deployments may require separate written terms, procurement terms, security requirements, data handling restrictions, or local-only configurations. Customers in these categories should contact Air Signal Labs before deployment to discuss applicable requirements.
8. General
8.1 Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
8.2 Modifications
Air Signal Labs reserves the right to modify these Terms at any time. Material changes will be communicated to reservation holders by email at least fifteen (15) days before the change takes effect. Continued use of the Services after a change constitutes acceptance.
